Rights & Licensing Statement

LTBR FM is an internet-only radio service operated from the United Kingdom. Its entire audio output — music, station identifications, jingles, production beds and spoken segments — is original content created for the station. The service does not transmit any sound recording, musical work, literary work or performance controlled by PPL, PRS for Music, MCPS, or any other collecting society, record label, publisher or performer.

Accordingly, the service does not hold, and is not required to hold, a PPL licence or a PRS for Music licence. The operator of LTBR FM warrants that the service is fully entitled to communicate its output to the public in the United Kingdom.

All music broadcast on LTBR FM is generated for the station using AI music-generation services, under the operator's direction, from briefs, style specifications and lyrics authored by the operator. Each track is produced specifically for a fictional artist created for the station and has never been commercially released by any label, distributor or aggregator.

The operator of LTBR FM warrants that the following applies to every recording in rotation:

• •The recording was generated under a paid subscription tier that grants commercial use rights, and was downloaded through the provider's approved channel within the applicable allocation.
• •The recording is not a copy of, and does not reproduce any part of, any pre-existing sound recording.
• •No human performer took part in the recording, and no performer's rights under Part II of the Copyright, Designs and Patents Act 1988 subsist in it.
• •Any lyrics were written by the operator or were generated as part of the same process; none are taken from any existing published work.

Station identifications, jingles and production audio are produced by the same process, or by text-to-speech and audio tools used under their commercial terms. No sampled material from any commercial recording, broadcast or aircheck is used.

Sound recordings. Under s.5A and s.9(2)(aa) of the Copyright, Designs and Patents Act 1988, copyright in a sound recording belongs to its producer — the person by whom the arrangements necessary for making the recording are undertaken (s.178). For every recording broadcast on LTBR FM, that person is either the operator or the generation-service provider, from whom the operator holds an assignment or licence permitting reproduction, distribution, public performance and communication to the public. No recording is owned by, or licensed to, any PPL member.

Musical and literary works. To the extent copyright subsists in the underlying compositions and lyrics, it belongs to the operator — either as human author of the lyrics and briefs, or as the person who made the arrangements necessary for the creation of any computer-generated work (s.9(3)). No work is registered with, or controlled by, PRS for Music or MCPS. The operator is not a PRS or MCPS member.

Performers' rights. No performance by an individual is embodied in any recording; no rights under Part II of the Act, and no entitlement to equitable remuneration under s.182D, arise.

Communication to the public (s.20). Because the operator owns or is licensed in every right engaged by transmitting the service, no consent from any third party or collecting society is required for communication of the service to the public in the United Kingdom, whether by the operator directly or by a directory or aggregator linking to the stream.

Broadcasting regulation. The service is delivered by internet only and is not a licensable broadcast service under the Broadcasting Acts.

The operator maintains a provenance record for every item of audio in rotation, recording: title; fictional artist; generation service and model version; date of generation; account tier at the time of generation; download record; and authorship of any lyrics. This record is available on request to any rights holder, collecting society, directory or aggregator with a legitimate interest, and is updated whenever content is added to rotation.

If you believe any audio transmitted by LTBR FM reproduces a work or recording in which you hold rights, contact rights@ltbr.fm with the approximate broadcast time, a description of the content and the basis of your claim. The operator will remove the item from rotation pending investigation within two working days of receipt and will respond in writing.

The operator of LTBR FM confirms that the statements above are true and accurate as at the date shown, that they apply to the entirety of the service's output, and that this statement will be updated before any content is transmitted to which it would not apply.

A signed declaration identifying the operator is provided on request to directories, aggregators, collecting societies and rights holders with a legitimate interest, via rights@ltbr.fm.
